NY judge dismisses Texas lawsuit against Ulster County doctor

KINGSTON, N.Y. (NEWS10) — A New York judge dismissed a legal challenge from Texas in an early test of New York State’s shield law to protect telehealth providers.

Texas Attorney General Ken Paxton sought to enforce a six-figure judgment against a New York doctor accused of prescribing abortion medication to a Texas patient. The judge ruled acting Ulster County Clerk Taylor Bruck was lawful in refusing to file the judgement issued by a Texas court against Dr. Margaret Carpenter.

The judge went on to write that the medical services provided by Dr. Carpenter are legal in New York and fall under New York Executive Law § 837-X. That’s the state shield law protecting providers of gender-affirming or reproductive care who offer services that are legal in New York.

The clerk said he was relieved. It was not clear if the trial court judge’s ruling would be appealed.
